Terms of Service

These Terms of Service ("Terms") govern your access to Fynvic, Inc.'s websites, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. You may not use the Service if you are prohibited by law.

2. The Service

Fynvic provides AI-assisted technical interview sessions in two modes:

• Practice — private rehearsal for your own improvement. Practice sessions do not produce shareable verified credentials.
• Verified — on paid verified plans, recorded screens with explicit consent that produce tamper-evident reports you may share with employers or others.

Verified reports are informational credentials you control — they are not employment decisions or hiring recommendations by Fynvic.

We do not perform live government-ID or biometric identity verification in V1. We do not score facial expressions, emotion, accent, or appearance. Scores are derived from transcript text, code evidence, and session timing — not biometric video analysis on our servers.

3. Accounts

• Keep credentials confidential; you are responsible for account activity.
• Provide accurate information and update it as needed.
• One person per candidate account unless we authorize otherwise.

4. Interview sessions & consent

Before a recorded session, you must complete our in-product consent flow. Sessions may capture microphone audio and transcripts. Optional camera preview during device check is not recording unless stated otherwise. Do not proceed if you do not agree to the consent shown.

5. Payments, taxes & refunds

• Paid plans are billed through our payment processor at prices shown at checkout.
• Session credits are consumed when you start a session of the matching type (practice or verified) per plan rules.
• If a verified report cannot be delivered due to a platform failure after payment, contact support for a refund or credit at our discretion and as required by law.
• Taxes may apply based on your location. Where required, we issue electronic tax invoices (including GST components for applicable Indian sales). Export of services treatment for non-Indian buyers is determined under Indian tax law and shown on invoices when applicable.
• Payment and invoice records may be retained for 7+ years after account deletion for tax and accounting compliance.

Report disputes (verified only): If you believe a verified report is materially incorrect, submit a dispute in the product or email legal@fynvic.com with your session ID and reason. We aim to acknowledge within 5 business days and resolve within 15 business days. Outcomes may include no change, a superseding corrected report (new report ID), or a refund/credit at our discretion. We do not silently edit sealed report rows in place.

6. Your content

You retain ownership of content you provide (speech, code, uploads). You grant Fynvic a limited license to process that content solely to operate the Service — run interviews, transcribe, score, generate reports, and store data per your retention settings. We do not use your content to train third-party foundation models beyond providing the Service under our processor agreements.

7. Acceptable use

You agree not to:

• Violate laws, infringe others' rights, or submit malicious code.
• Attempt to bypass proctoring, scoring, or access controls.
• Resell, scrape, or reverse engineer the Service except where permitted by law.
• Misrepresent reports as cryptographically signed if they are tamper-evident hashes only.

8. Reports & verification

Shared reports include tamper-evident integrity metadata (SHA-256 over canonical JSON). Reports may expire or be revoked. A "verified" report means the session was recorded with your consent and scored under our documented process — it does not mean we verified your government ID or identity documents.

9. Disclaimers & third-party use

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PRACTICE AND REPORT SCORES DO NOT GUARANTEE EMPLOYMENT OUTCOMES.

If an employer, bootcamp, or other third party uses your verified report in admission or hiring, that party — not Fynvic — is responsible for its own legal compliance (including automated employment decision tool laws such as NYC Local Law 144 where applicable). Fynvic does not verify government identity, does not make hiring decisions on behalf of employers, and does not transfer employer AEDT obligations to you or to those third parties.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYNVIC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID FYNVIC IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

11. Termination

You may delete your account at any time. We may suspend or terminate access for violations. Payment and audit records may survive termination as described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Disputes shall be resolved in courts of competent jurisdiction in Bangalore, Karnataka unless otherwise required by law.
